Gainful Employment Rule - Call to Action

TO ALL EMPLOYERS AND EXECUTIVES:

The U.S. Department of Education is again pushing forward with potentially harmful regulations that the government calls the “Gainful Employment” rule. This is the Department of Education's second attempt to pass such a rule. Its first attempt was struck down in 2012 by a federal judge in Washington, D.C.  Unfortunately, this newly proposed regulation could significantly impact the ability of business to hire workforce-ready employees. This regulation proposes to cut off federal student aid to students attending private sector institutions, whose former students don't meet particular metrics as determined by the U.S. Department of Education, and measured by factors such as their earnings, the amount of debt they incur and their default rate. In fact, the Department’s own press release estimates that 1 million students would be impacted by this rule.

If the government succeeds, this rule may shut down programs upon which you, as an employer, rely to produce qualified graduates who can fill the needs you have for an educated and trained workforce.

Students who count on federal financial aid to attend the college of their choice would be denied the opportunity to get the education they choose. It would mean important programs that presently serve to fill the skills gap in this country and train students for meaningful professions may be unavailable for many students, leaving them without the skills necessary to compete in the current job market. As an employer, you know first-hand the devastating impact this could have on both your company and our nation’s economy.

An educated and trained workforce is imperative to foster job and economic growth in the United States, and remain competitive in a global economy. The Gainful Employment regulation will do nothing to advance these goals, and in fact, would likely serve to deter them.

Many graduates of private sector institutions have successfully matriculated to employment with you and other members of the National Black Chamber of Commerce.  For this reason, we hope that you will feel compelled to express your concerns to the Department of Education and to your elected officials in Washington, DC as to the detrimental impact the Gainful Employment regulations will likely have on your business by impairing your ability to build and maintain a qualified workforce.

To facilitate that effort, the Association for Private Sector College and Universities (APSCU) has created a website, apscu.org/takeaction that allows you to communicate your concerns about this misguided rule to the Department of Education and your elected representatives in Washington, DC. We encourage you to take a few minutes to visit the APSCU website and make your voice heard about the potential negative impact this rule may have on our nation’s economy and your business operations.
